Ford Escape hatchback not locking

I am having problems with the hatchback of my 2001 Ford Escape. Sometimes it will not open when unlocked if you wait a few minutes then try again it will probably open. Also, when I lock the car up, the hatchback never actually locks, you can open it when it is supposed to be locked, however the car alarm will go off. This is going to be a problem for me as I hide Christmas presents back there and I don't want them to get stolen. I have an acquintance who also reports problems with the hatch occassionally not unlocking. Do others have this problem? If this is a defect, why should we have to pay for the repair?
