Hi Everyone,
So, I have a 1998 Mazda 626, 4-cylinder. My car broke down on 08/20/12 after over heating on the highway. I put it in the shop on 8/22/12. I sent it to the same shop that did my inspection since I bought the car in May 2012. Well, the shop diagnosed my car FIRST with a blown head gasket. The mechanic said I needed a new head gasket, water pump and thermostat. I bought the parts, gave it to them to have installed. Once eerything was installed they called me saying it wasn't the head gasket, I need a motor and radiator for my car. Ok, so I ordered the motor and radiator. All have a warranty. They put it on and the car was good. The mechanic called me on 10/4/12 saying the car was done, only thing was the transmission was shifting funny. I asked them why because the transmission was fine before the car broke down. I brought the car in their for a head gasket. He claimed it was no big deal, he put transmission fluid in it and it's fine. When my grandfather (who is a mechanic) picked up the car on 10/5/12 he said the car would not shift correctly. The speed-ometer went up and so did the RPM but the car did not move. After a while it did. So, I took the car back on 10/8/12 and the mechanic claimed the car was shifting funny because the sensor was bad and had to put a new one on there. So, I left...I ended up bringing the car back on the following day 10/9/12 because the car was shutting off on my while driving. The mechanic shop said the timing belt was slipping off, they fixed it and sent me on my way.

On 10/27/12, I was driving and noticed the car started shifting funny again. I pulled to my house, parked the car and stayed home. I spoke to my grandfather describing what happened that day and he said that's the same thing it was doing on 10/5/12. I went out to the car on 10/28/12 to see if it would drive, it went around the block and back home. However, later in the day it would not move at all. The RPM and the speed-ometer went up but the car did not move while in "DRIVE".

Since Hurricane Sandy was coming, the shop wasn't able to pick up my car until 10/31/12. They didn't look at it until 11/5/12. The mechanic called me and said the transmission pump went up and it would be $975 to fix it. Immediately I told him, the shop did something to my transmission. Everything was fine with the trasnmission before it came there, and the mechanic himself put that on my inspection papers.

Now, my question to you guys is: what could have happened to make my transmission pump go up? If the shop did the full diagnotics test why didn't they see it when they got my car in the first place? Please help, as I am taking this issue to court.
