My airbag didnt inflate.

My airbag didnt inflate. Sign In

OK, so yesterday i was making a turn in my BMW 323 and i hit some loose gravel on the turn and lost traction. I slid off the road through some grass and into a ditch lined with big gray rocks. So, my roof and side airbags deploy, by that i mean the side airbags panel came off but the air bag didnt actually inflate it just stayed rolled up inside the compartment. I was wondering if there's any legal recourse i can pursue. If it had been a more serious wreck i would be upset about the malfunction but really i just want the airbags replaced. I don't feel i should have to pay for something that has malfunctioned. My car doesn't have the feature to turn off my airbags. Thanks, Dylan.

Well with out knowing all the specifics(speed, damage, any SRS system codes, and probably 20 things I can't think of right now) it's really hard to give an opinion.....

I'll just make an observation which isn't worth a whole lot.....I'll go off the premise that the sideair bags did infact malfunction....

You were in an accident where the side impact sensors deemed it necessary to deploy your side & roof bags... The roof bags would be a no brainer, they worked so it's up to you or your insurance to fix that. Now they will probably take the stance that even though the side bags didn't deploy, if they did like they were suppose to it would be on you to fix them......

It think the only damages you would have been intitled to was if you had been seriously injured due to fact that the side airbags didn't deploy when they should have. I know repacking airbags is expensive (some cars are totaled due to this expense) and is sucks to be in this position....but since you put the car in the position where the bags need to be deployed I don't see how it's anyones responsibility since 2 bags didn't "deploy all the way"

The only other thing here would be if you could prove that bags deployed when they shouldn't have but from the limited information I have read, I think you would have a hard time proving that.

Personally between my health or looking at a huge law suit I would take my health.... and I can say that because I've been there..... I rolled my truck going 80mph due to a defective tire. I just want the cost of my truck but the 2 lawyers I talked to lost interest when they found out I wasn't hurt (I walked away, literally) thats when I dropped it..... I figure $3000 was well worth not being in a wheel chair or worse for the rest of my life and I wouldn't want to be there even for a million.

It's no one's fault, but your own. How about taking personal resposiblity for your actions? Darn. And I said that I was going to be nice. Sorry, guys. Couldn't help it.
