2006 silverado 4WD problem

Bought 2006 chevy silverado Z71 in 2010. Had 4wd serviced under warranty in january 2011. On ticket dealer stated they performed differerential carrier overhaul. 4wd code never cleared. Dealer told me they could not clear the code due to aftermarket modifications to communication system. Noise seemed to be gone. First snowstorm january 2012 and there is a severe noise in 4wd and locking up when turning. Independant mechanic narrowed it down to the front differential. I am no longer under warranty. Should the dealer be responsible for this repair?
