Who Owns My Truck

my brother in law towed my truck and moved it to his house when i was moving out of town and the truck wasn't running right. i have the title in my name and he has had the trunk for about a month, he won't give it back and he won't buy it from me, he claims he fixed it by blowing out the fuel filter, and he has pulled a dent in the door, with holes and a slide hammer(he can't weld the holes up so it just makes more work for me when i get it) so my question is do i have any standing to go and get the truck and if so can police help me get the truck if he says no. thats if he doesn't beat my a$$ first. help would be great thanks

Speaking for myself not this site - the truck is yours if you hold the title - PERIOD. You can and should notify police, check local laws and just go get it with the title of ownership with you and proof that it's you. Speaking just for Massachusetts the person with the title owns it. Worse is that you are responsible for it as the owner. You can't just junk or dump the thing without the title. You can't register it without the title either or pay for a duplicate. If another was faked in another name that would be theft and there would be a paper trail of that. One known exeption is called a mechanic's lien. If you signed to get something fixed and owe $$ for that, the shop/mechanic can hold the vehicle and even sell it to cover costs. In ions I've never seen anyone do that. If it was taken from you without your permission it's yours no matter what barring it being impounded by real authorities for assorted reasons. In those cases you would owe storage fees or other costs if over the value of the vehicle. If that vehicle has storage fees, parking tickets etc. - they belong to the one with the title! Call or visit police, know your rights and have it taken to where you want it. Tom is correct. If you have a valid title, simply bring the police with you and go get your car. I agree with Tom & HT. If you have the title you need to get the truck asap... Just a couple of footnotes that probably don't apply but I will mention them anyway. Where I'm at, 30 days is the magic number. I have 2 buddies with tow companys that pick up dead cars for the CHP. On the day of the tow the clock starts. 30 days later and one letter to the last known adddress they apply for a lost title and the car and everything in it is theirs. Even with private party stuff, after a certain point, property is considered "abandoned" and the previous owner has no legal claim anymore.... Don't let this drag on too long, the water is already muddy enough with him fixing a non running vehicle and doing other work to it......

After a bit of conversation he has agreed to give the truck back on the condition i pay 60 for the month he has had it as a storage fee. thanks again

Don't you just hate family fueds? Just get the vehicle out of there asap. Suks but if $60 bucks ends it and a relationship it could be the bargain of the century! T

It's crazy how people think 'possession' is 9/10ths of the law, its not! Especially when it comes to Real Estate and automobiles! Dana This year I've learned I'm much better at building websites than I am at repairing automobiles.
