What's the law on selling a car without air bags Sign In

Does anyone know the federal law on a dealer selling a car without air bags to a broker ? This broker did not know there were no air bags, fixed up the car and sold it. The buyer called about 3 weeks later and demanded her money back.

The broker said there was no info on his bid sheet about missing air bags. He has refunded the money to the woman to whom he sold the car. He is checking with his attorney as to his recourse with the dealership, but I am interested to know if a dealer can sell a car to ANYONE without divulging info about deployed/missing air bags?

I doubt there are any regulations at all on the subject other than your basic fraud charges if they could be proven. You can sell a car in any condition you choose to as long as you don't commit fraud.

At least the dealer refunded her money which was the right thing to do. Here you butt would be in hot water if you hid that if it was known. You could sell the vehicle but clearly stating that it had that issue if known.

No matter the laws - it would be plain immoral/criminal to sell a vehicle with a known safety problem and not state it that it would need tending to IMO,

You would think the SRS light would've been on, unless they installed a resistor inline in the harness in place of the missing bag....

Interesting question. Most Federal safety laws are a big no no to violate and I know seatbelts fall under this category. Air bags at the beginning didn't fall under that category just for the fact they were/are an enhancement to the seltbelts system and not many cars had them.

I'm really not sure how those laws have changed to keep up with times. Still not every car has airbags but does have seatbelts but on the reverse not every car has a TPMS system but you can't alter or tamper with those.....

Let us know what you find out and how this works out.......I'm curious to know....

Airbags are not required safety equipment, just like ABS is not. The only required safety equipment is the same stuff it always was, parking brake, seat belts and lights. It's not illegal to sell a car without them though. It's just illegal to operate it on the highway. That's the buyer's problem, not the seller.

Yea airbags have created a whole new problem. Most cars when a bags gets deployed, that is enough to total the car. I've seen so many cars with such little body damage that can easily get fixed being totalled due the cost of repacking the bag.

There are a lot of cars running around out there now with salvaged titles and those ones can only have liability insurance. You can't have full coverage on a car with a salvaged title....
