calipers leaking?

Good morning, I had alot of problems at the old shop i took my car to so... this morning I got mad and took my car to a new shop. Apparently i have calipers leaking and other issues but the new shop says (they have the paper work from the other shops quote) that I should have been told its a safety issue. The new shop said it should not have been allowed back out as it is a safety issue. I had it in 2 weeks ago for the quote and was not told about it being safety problem. My question is the new shop now has my car because they said they now know about the problem and because its safety I would have to sign a waiver that they have told me and I decided to remove the car without it being fixed yet. Is this true?

Sounds like they are using scare tactics. If you had a good brake pedal when you drove in and the brake light wasn't on, take it out of there and get another opinion. Something smells real fishy in the new shop.

1st off let me say that every shop has their share of problems. How they handle those problems determines whether a customer keeps them of fires them.
As far as this 2nd shop, I believe HT is correct, they are just using scare tatics which is morally wrong in all states and legally wrong in some.
The thing with waivers is you can't sign your rights away.
No matter what they put on that paper, you still have the same rights your state law allows as anyone else. If they feel they are liable for this car somehow (which their not, they did no work) and you signing this paper relieves them of this liability, they would be in for a shock if it went to court.
This is actually what shops see on the reverse. A shop is liable for the WHOLE brake system when they do work. So the WHOLE system has to be safe. A car comes in with the frt pads down to metal and has a small leak in a wheel cylinder in the back. The customer wants to sign a waiver saying they understand the leak and the shop isn't liable so they can just get the frt pads they want and not the wheel cylinders. What they don't realize is even though a waiver was signed by them, if the rear cylinder blew, causing a wreck they could turn around and sue the shop for damages and win even though they signed a waiver............ You can't sign away your rights........
If this is just a piece of paper saying you know the car is unsafe to drive, just sign it and get your car and let them know they just lost a customer.
If you don't want to sign it, call the cops, they have no legal right to hold your car.

The waiver is just another form or scare tactic.

Oh I agree, In my state it's illegal. The SAs are limited in what they can say about the repairs, which is a good thing. The only downside is with really unsafe stuff they really can't make it as clear as it needs to be and some folks have zero common sense, so that's a bad combination....
We had a Durango with a bad wheel bearing, we had to use a floor jack just to get it in & out of the shop. The lady declined the repairs and I saw her waking to the truck. I asked the SM "Did you tell her how bad that is!!!!!!!!!????????". He said " I told her it was bad & she shouldn't drive it, what'd ya want me to do, put a gun to her head? and really by BAR standards that is all he can say but not me....
I went out there and told her that wheel is going to fall off (it took way more words that that)They got a tow truck, the driver got in the truck to line it with his truck and the wheel fell off (actually fell into the wheel well) right there in the parking lot, the driver had to borrow our floor jack to get it on his truck....
My SM said..... See what were ya freaking out for,,,,she would've never made outta the parking lot.......All I could say was "What if she did....and made to the freeway"
